PROFILE WIJST ALLE ANDERE GARANTIES VAN WELKE AARD DAN OOK AF, INCLUSIEF GARANTIES VAN VERKOOPBAARHEID, GESCHIKTHEID VOOR EEN BEPAALD DOEL EN ALLE ANDERE GARANTIES DIE IMPLICIET DOOR DE WET OF ANDERSZINS WORDEN VERMELD. MET UITZONDERING VAN DE VOORGAANDE BEPERKTE GARANTIE WORDEN ALLE PRODUCTEN GELEVERD IN DE STAAT WAARIN ZE ZICH BEVINDEN. De voorgaande garantie vervalt bij elk gebruik of elke opslag van producten die niet in overeenstemming is met de toepasselijke productinstructies en voorzorgsmaatregelen, of bij elke wijziging of toevoeging aan de producten. Geen enkele werknemer of vertegenwoordiger van Profile is bevoegd om deze garantie op enigerlei wijze te wijzigen of aan te vullen, of om enige andere garantie te verlenen.    <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De enige en uitsluitende rechtsmiddel van de koper bij enige schending van de voorgaande garantie is het van Profile ontvangen van vervangende producten die aan de garantie voldoen, met inachtneming van de volgende voorwaarden: (i) enige schending van de garantie dient binnen 10 dagen na ontvangst aan Profile te worden gemeld en (ii) producten waarop een aanspraak op vervanging betrekking heeft, dienen franco te worden geretourneerd naar een door Profile aangewezen locatie. De verplichting van Profile in dit verband omvat geen transportkosten of andere kosten die verband houden met het retourneren en vervangen van producten.   <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Profile is niet aansprakelijk jegens de koper of enige derde voor indirecte schade, gevolgschade, incidentele schade, speculatieve schade, schadevergoeding bij wijze van voorbeeld of punitieve schadevergoeding van welke aard dan ook, noch voor schade aan eigendommen van de koper of een derde, ongeacht of dergelijke schade voorzienbaar was, ongeacht of Profile op de hoogte was gesteld van de mogelijkheid van dergelijke schade, ongeacht de juridische of billijkheidsgrondslag waarop de vordering tot schadevergoeding is gebaseerd, en ongeacht of een rechtsmiddel zijn wezenlijke doel heeft gemist.
